Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the TMS Sirsi online member portal at members.tmssirsi.com(“Portal”), operated by Sirsi Taluka Agricultural Produce Co-Operative Marketing Society Ltd. (“TMS Sirsi”, “we”, “us”).
1. Acceptance
By accessing the Portal — including browsing public market information or signing in with your account — you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Portal.
2. Eligibility
The Portal is provided for society members, assimi (associate) members, and registered purchasers with a valid TMS Sirsi account. You must use your own account credentials and the mobile number registered with the society. You may not access another person's account without their authorization.
3. Account access and OTP login
- Sign-in requires your account number, member type, and a one-time password sent to the mobile number on file.
- You are responsible for keeping your mobile device secure and for all activity that occurs under your session.
- Do not share OTP codes with anyone, including persons claiming to represent TMS Sirsi. Society staff will not ask for your OTP.
- Society members may use “Remember this device” to stay signed in on a trusted browser for a limited period. Sign out on shared or public devices.
- If you lose access to your registered mobile number, contact the TMS Sirsi office to update your records before attempting to sign in again.
4. Permitted use
You may use the Portal to:
- View your deposits, loans, stock, sales, and related account information.
- Submit requests and manage Portal preferences where available.
- View public arecanut market rates and market history.
You agree not to:
- Use the Portal for any unlawful, fraudulent, or harmful purpose.
- Attempt to bypass authentication, probe or attack the Portal, scrape data at scale, or interfere with normal operation.
- Misrepresent your identity or account relationship with TMS Sirsi.
- Reproduce, redistribute, or commercially exploit Portal content without permission.
5. Information accuracy and availability
The Portal displays information sourced from TMS Sirsi's systems. While we strive for accuracy and timely updates, displayed balances, rates, and records are provided on an “as available” basis. Official society records maintained at the TMS Sirsi office prevail in case of any discrepancy. Market rates shown on the Portal are indicative and subject to change without notice; they do not constitute a binding offer or guarantee of transaction price.
We may modify, suspend, or discontinue any part of the Portal for maintenance, security, or operational reasons, with or without notice.
6. Requests and transactions
Features that allow you to submit requests or save preferences through the Portal do not, by themselves, complete a financial transaction unless explicitly confirmed by TMS Sirsi through its normal office processes. Follow up with the society office when confirmation or original documents are required.
7. Intellectual property
The Portal, its design, software, and TMS Sirsi branding are owned by or licensed to TMS Sirsi. You receive a limited, non-exclusive, revocable license to use the Portal for personal, non-commercial account access in accordance with these Terms.
8. Disclaimer of warranties
To the fullest extent permitted by law, the Portal is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant uninterrupted, error-free, or secure operation.
9. Limitation of liability
To the fullest extent permitted by applicable law, TMS Sirsi and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of or inability to use the Portal. Our total liability for any claim relating to the Portal shall not exceed the amount you paid to use the Portal (which is zero for standard member access), except where liability cannot be excluded under applicable law.
10. Indemnity
You agree to indemnify and hold harmless TMS Sirsi from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Portal or violation of these Terms, to the extent permitted by law.
11. Termination
We may restrict or terminate your access to the Portal if we reasonably believe you have violated these Terms or pose a security risk. You may stop using the Portal at any time. Provisions that by nature should survive termination (including disclaimers, limitations of liability, and governing law) will continue to apply.
12. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page indicates the latest revision. Your continued use of the Portal after changes are posted constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of India. Any dispute arising from or relating to the Portal shall be subject to the jurisdiction of the competent courts in Karnataka, India, unless otherwise required by applicable cooperative society or banking regulations.
